1. General terms and conditions

1.1. Pogenemistoad.ee website’s (from now on: “Website”) terms and conditions (from now on: “Terms and conditions”) apply OÜ A360, register code 14765249, e-mail: info@pogenemistoad.ee (from now on: “Provider”) to all the website users (from now on: “User”).

1.2. It’s allowed to use the website to everyone who accept terms and conditions.

1.3. Using the website means:  visiting the website and using the materials on the website for whatever goal on however way.

1.4. User, who makes a order/booking on the website, identifies himself/herself by adding he’s/her’s personal information to the booking system and pays for the order/booking, will automatically make a sales contract with the provider at that moment.

2. Services and materials

2.1. Provider will offer trough the website access to escape room’s introduction and to the booking system.

2.2. Information and materials which are in the website, cannot be published without the permission of the service provider.

2.3. Service provider can’t make the changes with materials, structure, content and more, whenever and however provider wants.

2.4. Service provider updates and controls carefully the honesty and trueness regulary but won’t guarantee the honesty and trueness and is not responsible for it or the loss coming out of it.

3. Booking and the price of service 

3.1 To make a booking, the User fills in the required fields in the integrated EscapeNavigator.com booking system (first and last name, phone number, e-mail address). Payment is made securely via Stripe, using available payment methods (credit card, debit card, Apple Pay, Google Pay, etc.).

3.2 The User is obliged to provide true and correct information necessary for fulfilling the booking. The Provider is not responsible for problems resulting from incorrect information.

3.3 All prices shown on the Website are in euros and include VAT.

3.4 The Provider has the right to change prices at any time. If the prices are changed after the User has already made a booking and paid for it, the Provider will ensure that the User receives the service at the price valid at the time of booking.

3.5 After successful payment, EscapeNavigator.com will automatically send a confirmation of the booking to the e-mail address provided by the User.

4. Payment methods

4.1 Payments are processed through Stripe using credit and debit cards and other payment methods supported by Stripe (such as Apple Pay or Google Pay).

4.2 All payments are made outside of the Website in the secure environment of Stripe.

4.3 The Provider does not have access to the Customer’s bank or card data. This data is processed only by Stripe Payments Europe, Ltd.

4.4 OÜ A360 is the controller of personal data. For processing payments, the necessary personal data is transmitted to Stripe Payments Europe, Ltd in a secure manner.

5. Intellectual belonging

5.1 All the copyrights in the website belong to provider.

5.2 Photos, graphics, texts, sounds, animations, videos, website’s design and other intellectual belongings are defended by the Estonia Republic’s laws and international conventions. Protected is website’s structure and it’s content.

6. Policy of Privacy

6.1 By using the services of the Website, the Customer gives clear and informed consent to the processing of personal data under these Terms.

6.2 Personal data provided by the Customer is used to manage bookings and provide services.

6.4 The Provider may use the Customer’s personal data to send information about special offers and campaigns only if the Customer has given explicit consent.

6.5 The transmission of personal data is encrypted, ensuring the security of personal and payment information. Payments are processed outside of the Website in the secure environment of Stripe. The Website has no access to the Customer’s bank or card details.

6.6 The Provider undertakes not to disclose registered personal data to third parties, except where required by law or necessary for providing the service.

6.7 Personal data is processed by OÜ A360 (14765249, Side tn 9-46, Pärnu, Estonia).

7. User’s rights and obligations

7.1 User has the right to use the website within unity of terms and conditions.

7.2 User cannot use the materials or services on the website for the cause of fraud or for the cause of any law breaking action.

7.3 User has the obligation to follow the website’s rules and act with a good cause.

7.4 User is not allowed to use scripts, robots or other programs which are not for usual internet using.

7.5 User is forbidden to spread spam letters, chain letters, viruses and other technology, which can harm service provider or website.

8. Service provider’s rights and obligations

8.1 Service provider has the right to change the terms and conditions. Changes will apply at the moment when they are published in the website.

9. Retreating

9.1 Money, paid for the service, will be payed back only if user has not started using services. Retreating from booking less than 48h before the booking means no money will be payed back.

9.2 When user wishes to retreat from the order/booking, he/she has to contact as soon as possible via e-mail: info@pogenemistoad.ee

9.3 When retreating from the booking by right terms, money will be transferred back to the user as soon as possible but not later than 30 days after the retreatment. Money will be transferred to the same account it was ordering/ booking in the first place.

10. Responsibility 

10.1 Service provider is not responsible for delays, failures or interruptions which are caused because of the reasons which are out providers control, things like force majeure, electric failures, failures because of the internet service providers and more.

10.2 Provider is not responsible for possible harms or uncollected profit which could come from using or not using website. For any responsibility that comes, provider is responsible for only within the amount of sales price.

11. Applicable right and differences  

11.1 User and provider will cooperate based on terms and conditions, providers prices and by the laws of Estonia Republic’s obtaining laws.

11.2 If some points of the terms and conditions will be against the law of Estonia Republic, it will not change the other points in contract invalid.

11.3 All the different opinions will be solved by negotiations between user and provider. All the unnegotiable issues will be solved in the Estonian court.
